[코이오스의 뷰 ⑥] 성폭행, 문화적 낙인, 그리고 정의를 위한 투쟁에 대한 국경을 넘은 조사

저우 젠하오(Zhenhao Zhou)는 두 개 대륙에서 여성들을 성폭행한 중국 국적의 박사과정 유학생이었습니다. 경찰은 약 50명에 달하는 성폭행 피해자가 있을 것으로 추정하고 있으며, 현재까지 23명의 여성만이 공식적으로 피해 사실을 신고했습니다. 현재도 경찰은 피해 여성들의 증언을 계속해서 수집 중입니다.


피해자들의 익명 보호를 위해 이 글에서는 그들을 레이첼(Rachel), 앨리스(Alice), 베스(Beth)라고 부르겠습니다.


레이첼은 온라인을 통해 저우 젠하오를 처음 만났습니다. 두 사람은 원래 바에서 첫 만남을 가질 예정이었지만, 저우 젠하오는 그녀를 광둥성 둥관에 있는 자신의 집으로 초대했습니다. 저우 젠하오는 레이첼에게 알코올이 섞인 음료를 만들어주었고, 레이첼은 곧 어지럽고 무기력한 상태에 빠졌습니다. 이후 저우 젠하오는 그녀를 성폭행했습니다. 레이첼은 의식이 있었지만 말을 하거나 저항할 수 없는 상태였습니다. 그녀는 이것이 성폭행이라는 사실을 알았지만, 저우 젠하오의 집에서 술을 마신 상황 때문에 자신에게 불리한 증거밖에 없다고 느꼈습니다. 또한 둥관은 작은 지역이기에 가족, 친구, 동료들이 이 사실을 알게 되어 자신을 "부적절하고 무분별한" 사람으로 여길까 두려워 신고를 망설였습니다.


앨리스 또한 유사하게 동의 없이 약물을 투약당하고 부적절한 영상 촬영을 당했다고 말합니다. 2021년 런던에서 앨리스는 중국인 친구들과 클럽에 갔다가, 지인의 초대로 저우 젠하오와 함께 블룸즈버리에서 술을 마시게 되었습니다. 테이블 위에는 두 병의 술이 있었고, 앨리스와 그녀의 친구는 같은 병의 술을 나눠 마셨지만 저우 젠하오는 자신의 병만 마셨다고 합니다. 곧 두 사람은 극심한 졸림과 무기력함을 느꼈고, 저우 젠하오는 늦은 밤 택시를 타는 것은 위험하다며 자신의 집에서 잠시 쉬라고 권했습니다. 앨리스가 깨어났을 때, 저우 젠하오가 자신의 바지를 벗기고 있었고, 카메라 화면의 반사된 빛이 그녀의 몸을 비추고 있었습니다.


공포와 아드레날린에 휩싸인 앨리스는 방을 벗어나려 했지만,저우 젠하오는 그녀를 문에서 끌어당겨 막았습니다. 결국 그는 그녀를 놓아주었고, 경찰에 신고하지 말라고 협박했습니다. 이후 저우 젠하오는 중국 SNS인 위챗을 통해 그녀에게 다음 날 저녁 식사를 하자고 메시지를 보냈습니다. 충격에 빠진 앨리스는 그 이후로 저우 젠하오와 다시 연락하지 않았지만, 자신이 겪은 피해를 표현하기가 매우 어려웠다고 합니다. 그녀는 말합니다. “당시 우리 친구들 대부분은 (저우 젠하오가 하는 일에 대해) 알고 있었을 거예요. 여성 친구들 중 일부도 알고 있었던 것 같아요.” 실제로 그녀의 친구 지에(Jie)는 저우 젠하오의 범죄 사실을 알고 있었지만, 여러 관계와 연결고리 때문에 입을 열지 못했다고 고백했습니다.


마지막 피해자인 베스는 자신이 겪은 피해를 온라인에 공유하면서 다른 여성 피해자들과 연결되었습니다. 이들은 영국 경찰의 협조하에, 중국에 있으면서도 직접 런던에 가지 않고 온라인을 통해 자신의 증언과 증거를 제출할 수 있었고, 이로 인해 점차 자신의 피해 사실을 공유하고 여성의 신체적 권리에 대해 목소리를 낼 수 있게 되었습니다. 


한 피해자는 이렇게 말했습니다. “내가 좀 더 일찍 말했다면, 나 이후에 당한 피해자들이 줄어들었을지도 몰라요.” 또 다른 피해자는 “그게 신고 가능한 일인지조차 몰랐어요.”라고 밝혔습니다. 이 발언들은 성폭력에 대한 사회적 낙인과 침묵을 조장하는 분위기, 그리고 성적 권리에 대한 교육의 부재가 얼마나 심각한지를 잘 보여줍니다.


런던에 있는 동남아 및 동아시아 여성 협회(SEAWLA)의 이사 사라 예(Sarah Yeh)는 이렇게 말합니다. “외국 국적자들이 영국의 법률 체계와 NHS를 이해하고 이용하는 것은 매우 어렵습니다. 피해자 지원 서비스를 아예 접근조차 하지 못하는 경우도 많아요.” 언어 장벽이나 문화 차이로 인해 어떤 권리가 보장되는지, 어떤 지원을 받을 수 있는지 알지 못하는 경우가 많으며, 이로 인해 피해자들은 더욱 무력하고 절망적인 상황에 놓이게 됩니다.


그러므로 이제는 정부와 시민 모두가 성폭력에 대한 인식을 전환하고, 그 피해의 심각성과 광범위한 영향을 직시해야 할 때입니다.

Zhenhao Zhou was a Chinese PhD student who raped women across two different continents. While police estimate around 50 victims of sexual assault, only 23 have reported back to the police so far. As of right now, police are continuing to collect testimonies from the women whose fundamental human rights were violated.


For the sake of anonymity, we will call the victims Rachel, Alice, and Beth.


Rachel met Zou online, and while they initially scheduled to go to a bar for their first date, Zou invited her to his house in Dongguan, Guangdong Province. Zou then made her a concoction of alcohol that left her feeling dizzy and languid. Afterward, he proceeded to rape her, leaving Rachel in a state of pure agony as she was fully conscious but unable to speak, to shout that Zou was sexually assaulting her. While she contemplated reporting this as a case of sexual assault, Rachel realized that she did not have enough evidence to support the fact that she did not consent to having sex since she was willing to drink at Zou’s house. Also, Rachel carried her family’s reputation on her shoulders as Dongguan is a small area where her friends, relatives, and colleagues would eventually find out and critique Rachel’s “unorthodox” and “indiscreet” behavior.


Alice articulates how in the same way, she was also drugged without consent and filmed inappropriately. In London in 2021, Alice was clubbing with her Chinese friends when a mutual friend invited her to drink with Zou in Bloomsbury. Alice recalls two bottles on the table, and how she shared drinks with her friend but Zou was only drinking from his bottle. Soon after, both Alice and her friend felt a wave of lethargy passing over them, and with Zou’s strong insistence that it would be dangerous to take a taxi late at night, he welcomed her to take a nap in his place. When Alice woke up, she saw Zou undressing her pants with the bright light from the reflection of a camera screen illuminating her body.


Alice, filled with apprehension and adrenaline, attempted to leave the room, but with Zou holding back, she was “yanked back from the doorway”. Eventually, Zou let go and threatened her not to tell the police. He even messaged her on WeChat, the famous Chinese social networking service, to have dinner the next day. Shaken by the experience, Alice never contacted Zou again, but she felt reluctant to express the violation that she encountered. Alice remarks, “A lot of our friends at the time probably knew [what Zou was doing]. I reckon some of our female friends knew too”. In fact, one of Alice’s friends, Jie, had known about Zou’s crimes, and while he refused to “collaborate” with Zou in spiking women’s drinks, Jie felt reluctant to speak up because of the various friendships and connections that they shared.


Finally, Beth, another victim who experienced the same violation of human rights, posted about her experience online, which connected all of these women to share their experiences. Eventually, with the support of the British police who allowed the Chinese victims to share their experiences and evidence online instead of physically flying to London, the women were able to gradually open up and advocate for their bodily rights.


One of the victims reflected, “If I had spoken earlier, maybe there wouldn’t have been so many victims after me”. Another said, “I didn’t know that was something you could report”, both of which truly underscore the societal stigma around sexual assault cases and the urgent need to increase education on sexual rights, especially from a young age.


Sarah Yeh, a trustee at the Southeast and East Asian Women’s Association in London, expresses that it can be especially difficult for foreign citizens to “...have to navigate the British legal system and the NHS, or even access the services provided for victims”. Because of a lack of awareness of what resources, guidance, or human rights are protected under certain legal systems, victims can often feel trapped or hopeless, especially if they are not fluent in the country’s language or familiar with the country’s culture. Hence, governments and citizens alike must have a paradigm shift--a fundamental shift in perspective on sexual assault and its widespread, destructive impact.
